These Terms & Conditions (“Terms”) govern your use of our websites (including willowtreethe.com and any locations where these Terms are posted) and are an agreement between you and Willow Tree (and its subsidiaries and affiliates). If any product or service has its own terms, those shall prevail in case of conflict.

These Terms contain binding arbitration and a class-action waiver. See the “Dispute Resolution and Arbitration” section for details and how to opt out.

Use of Site

Your use of the Site constitutes your agreement to comply with and be bound by these Terms. If you disagree with any part of them, please do not use the Site.

  • Children under 13 may not use the Site.
  • Those aged 13–17 may use the Site only with the consent and supervision of a parent or legal guardian who agrees to these Terms.
  • If you are agreeing to these Terms on behalf of a minor (13–17), you accept responsibility for their use.

We reserve the right to refuse or cancel orders, limit quantities, or correct errors or inaccuracies, including after an order has been submitted.

All content on the Site—text, images, graphics, audio, etc. (“Content”)—is owned by or licensed to Willow Tree and protected by copyright, trademark, and other intellectual property laws. You may download, print, or store selected portions for personal, non-commercial use only, provided you:

  • Do not use the Content for commercial purposes.
  • Do not post or share the Content on other websites or networks.
  • Do not modify or remove copyright/trademark notices.
  • Give proper attribution when required.

Any rights not expressly granted are reserved. You may not copy, distribute, publicly display, or create derivative works without express written permission.

Comments, Feedback & Submissions

We welcome your comments, ideas, and feedback (“Comments”). However:

  • All submitted Comments become our exclusive property — we may use, publish, or distribute them freely.
  • Do not send any confidential or proprietary material you do not want us to own.
  • By submitting, you grant us a complete assignment of all rights in your Comments globally.

Mobile Messaging

If you have consented to receive SMS or automated calls, you agree to receive such messages or calls about your account, orders, or promotions. Message and data rates may apply. You must provide a telephone number where you are authorized to receive such communications. If you deactivate your number, it is your responsibility to notify us.

Our Site may link to third-party sites or services. We do not control or endorse their content and disclaim liability for any harm arising from use of those external sites.

Colors & Display

We try to depict product colors accurately, but cannot guarantee that the device or screen you are viewing will display them correctly.

Product & Pricing Information

We attempt to provide accurate product, price, and availability information, but errors or inaccuracies may occur. We reserve the right to correct mistakes, even after an order is placed.

Prices are shown in U.S. dollars and apply only to U.S. orders (unless otherwise noted). Product availability is not guaranteed; if an item becomes unavailable during processing, we will notify you.

Order Changes & Cancellations

You may request changes or cancellation as early as possible, but once an order enters the shipping process, changes or cancellations may not be possible.

Brand & Graphic Standards (for Authorized Retailers)

Authorized retailers must follow guidelines for usage of our brand names, trademarks, logos, domain names, and marketing materials to protect the integrity and authenticity of Willow Tree. Retailers must not:

  • Use our brand names in their domain or business name
  • Alter logo elements, fonts, or colors
  • Display our marks more prominently than their own
  • Imprint our images on unrelated materials

All uses of our brand must be truthful and not imply unauthorized affiliation or endorsement.

Authorized Reseller Policy

To remain an authorized reseller, one must:

  1. Maintain current business and location information
  2. Comply with trademark and branding policy
  3. Avoid using mark names in domain names, social media, or logos
  4. Refrain from selling via unauthorized third-party marketplaces unless approved
  5. Sell only to end consumers, not bulk resellers
  6. Purchase directly from us, not from unauthorized sources
  7. Sell only in original packaging
  8. Avoid commingling with other sellers’ inventory
  9. Not bundle, re-SKU, or modify products without approval
  10. Avoid advertising the product in ways that imply false associations
  11. Operate only via approved retail websites
  12. Provide quality customer service reflective of our brand
  13. Inspect products for defects, handle recalls, and comply with packaging and warranty standards
  14. Maintain compliance with applicable privacy and security laws

Violation of policy may result in suspension or termination of the retail relationship.

Supplier Code of Conduct & Compliance

We uphold ethical practices, compliance with laws, and respect for human rights in our supply chain. Our vendors must adhere to our Code of Conduct, including prohibitions on forced labor, and must allow compliance audits.

Disclaimer & Limitation of Liability

The Site and all content are provided “as is,” without warranties of any kind, express or implied. You assume all risk associated with using the Site. We are not liable for any damages—direct, indirect, incidental, consequential or otherwise—arising from your use or inability to use the Site, including errors, interruptions, viruses, or inaccurate content.

Indemnification

You agree to indemnify, defend, and hold us harmless from all claims, liabilities, costs, and expenses (including attorneys’ fees) arising from your use of the Site or your violation of these Terms.

Dispute Resolution & Arbitration

Applicability
These terms apply to all disputes between you and Willow Tree, whether in contract, tort, or otherwise, except for intellectual property claims or trade secret misappropriation.

Opt-Out
You may opt out of arbitration (and class action waiver) by sending a written notice within 30 days after first agreeing to these Terms. After that period, arbitration and waiver provisions apply.

Dispute Notice & Mediation
Before initiating arbitration, either party must send a written notice describing the dispute and seek informal resolution within 60 days. If not resolved, the dispute must proceed to mediation (non-binding) before arbitration can begin.

Arbitration
If mediation fails, disputes shall be resolved by binding arbitration (except small claims). The rules of the Arbitration Provider will apply, subject to modifications in these Terms. You and we each waive the right to trial by jury and participate in class, representative or mass claims. The arbitrator’s decision is final, binding, and may be enforced in court.

Severability
If any provision of this arbitration section is invalid or unenforceable, that part may be severed; however, if waiver of class or representative claims is unenforceable, the entire arbitration section becomes void. Other terms remain unaffected.

Venue for Other Matters
Any claims excluded from arbitration must be brought in state or federal court in Kansas (or other jurisdiction as allowed by law), and parties consent to those courts’ jurisdiction.

Personalization Terms & Conditions

If you order personalized products (e.g. engraved items):

  • Text is etched (not sticker or ink)
  • Proofread carefully before confirming your order
  • Emojis and special symbols not permitted
  • We are not responsible for mistakes you make
  • Personalization orders are final, non-returnable, and cannot be cancelled
  • We reserve the right to decline orders with unacceptable content

Governing Law & General Provisions

These Terms are governed by the laws of the State of Kansas (excluding conflict of law rules). All claims, disputes, or actions related to these Terms, our Privacy or Security policy, or your use of the Site must be brought in the courts of Kansas, to which you consent to personal jurisdiction.

Your use of the Site constitutes your acceptance of these Terms and any other policies that govern your visit or purchases. We may modify or update the Site, our policies, or these Terms at any time, and your continued use binds you to the changes.
